Questions

Can pets be banned in the units?

The statute does not authorize a general ban. Article 21 item IX forbids keeping animals that, by their number, size, or nature, affect the condominium’s safety, health, or comfort. Article 53 item XIV leaves the internal rules to set measures and limits on companion animals, and says assistance dogs are not subject to any of those measures: their owners may use the common areas without restriction.

Do I have to pay cuotas de mantenimiento if I do not live in the condominium or use the common areas?

Yes. Article 18 says that not exercising the rights, or giving up the use of certain common areas and property, does not exclude the obligations in the statute, the constitutive deed, and the internal rules. Article 55 requires each owner and, where applicable, the possessors to pay the assembly’s fees, split by undivided share, for the administration and maintenance fund and the reserve fund.
