Questions
What can I do about a neighbor whose dog barks all day or makes a disturbance?
Ley 10.751, article 9, forbids an owner from doing anything that disturbs the other owners’ peace, or that compromises the building’s safety, solidity, or health. The same ban applies to a tenant and to anyone given use of the unit. Article 10 lets a judge, at the request of the administrator or any owner, fine whoever breaks the previous article and order the prohibited acts to stop.
What majority approves closing a terrace or changing the facade?
Ley 10.751, article 12, requires a meeting called for that purpose and a majority of two thirds of all the owners, representing at least three quarters of the building’s value, for works that change the architectural appearance or the extent, area, or use of the common property, when they do not harm stability, safety, and health. Article 3 lists the roof terrace as common property, which cannot stop being common.
What quorum does the assembly need if the first call does not reach a majority?
Ley 10.751, article 18, requires a majority of the owners representing at least three quarters of the building’s value. If an hour after the first call that quorum is missing, those present may meet and decide by a simple majority of the people there, whatever share of the value they represent, unless the statute or the bylaws say otherwise.
