Questions

What quorum installs the ordinary assembly, and what happens on the second call?

Article 1023 of the Civil Code says an ordinary meeting on the first call is installed with owners representing at least 51% of the condominium rights. If that percentage is not met, a second call is made no sooner than seven and no later than fifteen days later, and the meeting is held with whoever attends. Ordinary resolutions are valid when decided by the percentage majority of the rights represented by those present.

What majority do extraordinary-assembly decisions need?

Article 1023 says an extraordinary meeting may be held with the owners who attend, but its agreements are valid only if owners representing at least 75% of the rights in the condominium approve them. That approval may be completed within the following thirty calendar days by absent owners who authentically say they know the agreements and approve them.

How are maintenance costs split among the units?

Article 1026 says owners contribute to maintenance and operating costs, and to the reserve funds, based on the percentage each private unit represents in the condominium. If a stair, courtyard, garden, elevator, or other installation is for the exclusive use of one or more owners, those costs are borne by the people who use it directly and exclusively.
