Questions
How are common-part expenses split?
Article 2140 of the Civil Code says the costs of preserving and using the common parts, the services in the common interest, and improvements agreed by the majority are borne in proportion to the value of each owner’s property, unless agreed otherwise. If the thing serves the owners to different degrees, the cost is split in proportion to the use each one can make of it. If a stair, courtyard, or installation serves only part of the building, that cost belongs to that group.
What quorum constitutes the assembly, and what happens on the second call?
Article 2155 says the meeting is constituted with owners representing two thirds of the building’s value and the same proportion of the participants. Resolutions pass with votes representing a majority of those present and at least half the building’s value. If it cannot deliberate for lack of numbers, it meets on a second call within ten days, and a resolution passes with votes representing one third of the owners and at least one third of the value.
What majority approves changes to common property?
Article 2156 says improvements aimed at making the common things better, more comfortable, or more productive must be approved by votes representing a majority of the owners and two thirds of the building’s value. The meeting cannot deliberate unless it is shown that every owner was invited.
